Even thought a bail bondsman was on hand to post bail, Lohan was denied bail and is on her way to jail.

She will be in jail until October 22, 2010 when her probation violation hearing is set. The sheriff CAN NOT SET HER FREE because she is in jail waiting for this probation hearing.

Some attorneys say that once she attends her probation hearing, the judge may give her a sentence of 30 days, and count the time in jail waiting for the hearing for time served.

What a waste of a career. These drug allegations will make it difficult to insure her for films and when that happens, no parts are offered.

to make my point (yes i know this is here say but still) my friend in my lil home town was arested for having on him under a gram of weed (not OZ but gram) he was held for 3 days then released and charged fines and probation terms.... now he failed is first drug test and was givin a 5 month sentace with only 3 served. after he served his 3 months he was released and then almost a year later was caught again for smokeing in public and possesion this time its was under an oz about 10 grams he claims, he is now serving a 18 month sentence 12 with good behavier.

Yes you would have been released early from jail. The sheriff was just following the LAW. No you would not have gotten a private cell because you have no celebrity status that some dirt bag looking to make a name for themselves would look to harm you. The sheriff is not stupid. He will not let celebrities get hurt.

Was your friend busted in California? Did his lawyer think he was sentenced outside the guidelines set by the laws of your state? If so did he motion for mistrial based on that? If not, why not?

All judges followed the law in passing judgment on Ms Lohan's past crimes. If they did not all others sentenced for the exact same crimes by this judge have the right to seek mistrial. Now if the prosecutors did not bring the proper charges then the citizens have to get after them for that. He represents them and he answers to them. If any one is to blame for her lack of punishment it is the state's prosecutors.

Hopefully -- and it sounds as though it will -- Lindsay Lohan will spend the full 30 days in jail. She's gotten off pretty easy so far, being let out way early on her previous jailings, and her "rehab", but it sounds like 30 full days. Now if the law will jail her fellow "bad girl", Paris Hilton, maybe actual justice can make some strides. I have learned to ignore REPORTERS when they comment on court cases because they are clueless for the most part.

Instead, I listen to LAWYERS who have actual knowledge. In this case, I listened to a lawyer who represents celebrity clients for drug charges, and he said 30 days.

How "overcrowded" could a private cell be? How "hard" is she trying? Out of rehab for, what, a few weeks, and already she's been into drugs...yeah, that's really a commitment to trying. Fred G -- I have to tell you --- I've never heard drug testing called a "whiz quiz" before, and I almost fell off my chair laughing.

Now serious -- This woman is in serious trouble, IMO, with her addictions and/or dependencies for a few reasons:

• She hasn't admitted to herself and counselors that she needs help, because she keeps repeating the same mistakes.
• Her fame and wealth (and maybe drugs) seem to have clouded her reasoning skills as to the important things in life.
• She has a platoon of enablers: drug dealers, family, friends, doctors, pharmacists, lawyers, the judicial system.

As a person who's old enough to be her mother, my heart does goes out to her simply because I know a lot about addiction/dependency and what it does to people and their families. There are several steps in the downward spiral ... and the drop-off point is often death.

From my own experience, a person will not be ready to be "clean" until he/she is ready to assume ownership of the problem and take each day of sobriety as one step forward. I don't know anything about Lohan other than what I see in the news, and I don't like where she's going. She apparently had promise and was a cute kid. But right now, she has too many people helping her die.

I wish people would get their facts straight. Lindsay has access to top attorneys, but most judges know to follow the book due to the high profile. I've seen so many average drug addicts booked on "soft felony" charges, and are released just as fast as any rich person, yet they didn't spend nearly the amount of money. The only "celebrity treatment" celebrities get (which I tend to admit is a lot) is they don't tend to get abused, disrespected, or accidentally injured while in custody. Also, I have a feeling the cells are MADE SURE" to be clean and habitable before a celebrity is locked up.

I would just make one small correction to the article. Lohan is not subject to 30 days in jail. She is subject to 30 days for EACH drug test she failed or skipped. We know that she failed three (cocaine, alcohol, and amphetamines) and then she wisely stopped taking the tests and has skipped several more. Here potential incarceration is around 6 months or more at this point.

And also, no rehab facility is going to do in the future what the UC Medical Center did and release her after stating that her addiction status was not severe enough to warrant treatment. It made UCMC look bad and other rehabs will be paying attention.

There is a lot of discussion back and forth where Lohan is getting too harsh a deal or too light a sentence because of her celebrity status. It is my position that when a person steps voluntarily into the celebrity spotlight, they serve as a role model for many impressionable young people. The sentence needs to be severe, not just because Lohan deserves it, but because a message needs to be sent to her "followers" that this sort of behavior is unacceptable.

Don't send her here to Texas. We've got enough idiots to deal with already!

Lohan seemed to acknowledge an addiction problem after news of her positive drug test broke last week.

Huh uh.....I worked in a psycho hospital and many a patient was discharged that I predicted they would use in the car before they were out of the parking lot. And they did. And eventually they came back.

She has to bottom out and she hasn't reached that point because she is surrounded with enablers. #1. her mother.

I heard that you can get good drugs in jail. Maybe that's why she doesn't seem too upset about returning.

The young lady has been ordered to rehab with the requirement that she submit to random drug/alcohol tests and she continues to do the same thing. My grandfather once said, "your IQ is judged by how you learn from your mistakes". This makes Lindsey an pure idiot.

her behavior is certainly not role model quality, she needs help, as i said she is a repeat offender who unfortunatly is going to be a statistic unless she gets serious emotional and mental help! 2 days in jail or 2 months in jail is not going to change the way her mind works unless she gets an intervention! her parents are useless in this matter because they defend her, if this was my daughter, she would be parking her butt in a rehab facility, followed by therapy,counseling, whatever it took!

Doing therapy, counseling and rehab will not help one bit until she makes up her mind that she is going to change her behavior.

tigger....the Judge can sentence her to 100 years....but the Judge isn't the one with the power after the sentencing...its the Sheriff in this case, if the jail is over crowded he/she has the authority to release inmates early... and after that it was the "Experts" from the rehab facility she went to that said that the poor little thing was misdiagnosed with ADD....and that her meds caused all this...you know....the smug attitude...the cocaine...the drunk driving...they were the ones who stood up and demanded she be released.

The only way shes going to stay locked up for any length of time is if shes sentenced to State prison, which requires a sentence of more than a year.... or if she screws up and gets arrested outside of Lynwoods area where the jails aren't so over crowded.

They let out the rich and famous, but the city kid will never get out. Nail her to the legal cross like you would anyone else.

The money should only mean you can fine her more and get it!

She has everything that most people would want, money, fame (notice I didn't mention talent) and what does she do pfffttt they can't mess with me I'm rich and famous.

If any of you people claiming she gets better treatment sentence wise would do just 3 minutes of research you would know it is NOT true. All of her crimes and sentences for those crimes have been in line with not only California law but with any of the people who have committed the exact same crimes. If she wasn't sentenced with in the same limits, all the others would have legal and constitutional grounds to seek mistrials. These judges are not stupid folks. They follow the law.

The sheriff may keep her away from others because he is not going to let her get hurt. That is the last thing he or the state needs. He also follows California LAW when it comes to early release. She got what the law told the sheriff to do. No more. No less.

Others tried complaining they were treated worse then Paris Hilton when she went in for a couple of hours. One was found to have never even been booked and never sat in a cell yet she complained Paris was treated better. She was hoping to sue the state for money until some one did some RESEARCH. That shut her up.

I do not condone the behavior by these or any other people one bit. But I do know they are being treated the same except for keeping them safe from harm.

Which, I don't understand in this day & age, with the money they have - they can't hire a driver or rent a limo? There is absolutely no excuse for this. Funny about her reduced time - news media analysts were shocked about how strict/harsh the judge came down on her giving her 90 days jail/90 days rehab. We all knew she wasn't going to serve the whole time...now look where she is.

This is the first person who has made any sense. I'm the mom of an addict/alcoholic and lived through 4-5 years of hell that I wouldn't wish on anyone. He was in rehab 7 times and finally was lucky enough to end up in a program with the courts. If he followed their rules, he'd have his record wiped clean. He tested dirty a few times, then back to jail. There's nothing worse for a parent to talk to their child through glass on a phone in a filthy place. What finally turned him around, was getting arrested and us refusing to bail him out. He finally learned that he was the only one responsible for his life. I'm happy to say he has turned his life around, is straight and sober, got married and is about to make me a Grandma. Obviously this girl never had any real parental emotional support which is really a shame. Of all the people my son dealt with in rehab and jail, the only ones that were successful were the ones where their parents stuck by them and loved them.

Lindsey's parents are caught in a dilemma. They don't want to pi$$ her off (by trying to force her into rehab, hence the denial of all her issues) because if by some chance she ever gets another acting gig, she's their meal ticket. At the same time, if everyone in her life keeps enabling her, she'll end up dead, and then where would her loser parents be? Seriously, what are they without Lindsey? Absolute nobodies. Not that Lindsey's a prize, but let's face it, she IS a celebrity (of sorts).

Substance abuse is a serious CHARACTER FLAW. It's possible for Lohan or anyone else affected by such a flaw to reverse the collision course their life is on. However, the offender must first WANT to change their life more than they want to continue the behavior. Sadly, most never reach a point of wanting to change -- with a willingness to do the hard work.

Lohan may have talent, but there are a gazillion young actresses who are just as talented or more so, who are more reliable than this trailer trash brat. I'm sick of the media pandering to these people and wish they would provide news and information about people who are positive role models. They now have these wonderful inventions called breathalyzers they can attach to the starter in your car, my uncle who has many DUI charges has one, if you don't do the breathalyzer you can't start your car or if you have to much alcohol in your system the car won't start...GENIUS! Why don't they do they to Lindsay?? It would probably stop her from driving because she would be to stoned to remember to do it or to drunk and the car wouldn't start.

@ allison-1885165 --- I don't know what random types of drug tests you're talking about, but anabolic steroids, which are drugs for abnormal enhancement strengths, have been used in sports since the 1950s. Many athletes have eluded testing in many ways.

The same goes for student drug testing in schools - there are ways around it, and the students know how to do it.

Why would you want add actors to the mix and be tested? For what drugs -- pot, coke, heroin, Oxy? What about alcohol? Unlike sport people and and live performance musicians, movie actors can do many retakes to get their "performance" sober.
